Terms of Service

These Terms of Service (the "Terms") govern your access to and use of Tu Waifu (tuwaifu.online and its associated domains, the "Service"), operated from Mexico by Héctor Hugo Rivera González, an individual ("Tu Waifu", "we", "us"). By accessing the Service, creating an account or using it, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Adults only (18+)

The Service is intended exclusively for people who are at least 18 years old (or the age of majority where you live, if higher). By using it you represent that you meet this requirement. Minors may not access the Service. If we learn that an account belongs to a minor, we will close it immediately and delete its data.

Your local laws. You are responsible for making sure that accessing adult content and using the Service is legal where you are, and for complying with your local laws.

Additional age verification. We may ask you to confirm your age at any time, for example if there are signs that you may be a minor or if the law requires it. Verification is carried out by a specialized third-party provider; we only keep the result (verified yes/no) and the date, never a copy of your ID. Until it is completed, we may limit or suspend the account. If you believe a decision is wrong, you can appeal as described in section 9.

2. The Service and fictional content

Tu Waifu is a chat platform with AI-powered virtual companions for adults, which may include roleplay and adult (NSFW) content.

AI replies may be inaccurate, inappropriate or unexpected. They are not professional advice (medical, psychological, legal, financial or otherwise). A virtual companion is not a substitute for professional help or human relationships. If you are in crisis or thinking about harming yourself, please seek professional help or contact your local emergency services (for example 911 in the US and Mexico, or 988, the Suicide & Crisis Lifeline, in the US; in Mexico, Línea de la Vida: 800 911 2000).

3. Price: the Service is free

The Service is currently offered free of charge. We do not ask for payment details. We may introduce optional paid features in the future; if we do, we will announce them clearly in advance, update these Terms, and nothing will be charged without your explicit consent. Free features may change as described in section 13.

4. Your account

Some features require an account. You must provide accurate information, keep your password confidential, and you are responsible for all activity under your account. Your account is personal and non-transferable: you may not sell, transfer, lend or share it. Tell us immediately at sistemas@tuwaifu.com if you suspect unauthorized use.

5. Prohibited content and conduct

You may not use the Service to create, request, describe or share:

• Any sexual or sexualized content involving minors, or characters who appear to be minors (by appearance, stated age, features, clothing, school setting or any other indication), whether real or fictional. We have zero tolerance: the account is permanently banned and, where appropriate, reported to the authorities.
• "Aged-up" characters: characters declared to be adults but with a childlike appearance, body, features, voice or behavior, or justifications such as "she's 1,000 years old", "she's an ancient vampire/elf/goddess" or "she's an adult in her world" used to sexualize a child-like character.
• Non-consensual sexual content, including rape, sexual abuse, coercion, or characters who are unconscious, drugged or unable to consent.
• Incest or sexual relations between family members.
• Real people: sexual or defamatory content about identifiable real people (celebrities, public figures or private individuals), impersonation, intimate images of others, and deepfakes or images that use a real person's face or identity (see section 7).
• Bestiality, necrophilia, extreme sexual violence, or fetish content involving bodily fluids or waste (urine, feces, vomit, menstrual blood and the like).
• Content that promotes self-harm, suicide or eating disorders.
• Terrorism, violent extremism, hate speech, threats or harassment.
• Promoting, offering or facilitating commercial sex, prostitution, pimping or human trafficking, or any other illegal activity: fraud, sale of drugs or weapons, exploitation, or infringement of third-party copyrights, trademarks or privacy.
• Attempting to bypass safety filters or moderation, attack the infrastructure, reverse engineer, use bots or scrape data at scale, or resell access without authorization.

You also may not:

• Submit false or bad-faith reports, or abuse the reporting and appeal channels.
• Harass, threaten or insult our staff or other users.
• Sell, transfer, rent or share accounts or access.
• Create a new account after a ban or suspension, under any name or email, or use the Service through third parties to get around the measure.

6. Automated moderation and human review

To enforce these Terms and the law, prompts, characters and generated content are automatically scanned by filters and classification systems. Content flagged by these systems, reported by other users or related to a support request may be reviewed by an authorized person. We may automatically block replies, remove content or limit features. Our Privacy Policy explains who can read your conversations and when.

7. Real people, intimate images and deepfakes

You may not create, upload or distribute intimate sexual images, videos, audio or text of a real person without their consent, including content created or altered with AI (deepfakes). In Mexico this may constitute the crime of violation of sexual privacy (the reforms known as the Ley Olimpia), and it is illegal in many other countries. If an affected person or their representative reports it through Contact & Reports, we will remove the content and any copies we identify on the Service within 48 hours, ban the responsible account and preserve the evidence needed by the authorities.

8. Your content and ownership

• We do not claim ownership of your prompts, messages or the characters you create. You are responsible for that content and for how you use the results.
• AI-generated output: we do not guarantee that AI replies or images are protected by copyright. Mexico's Federal Copyright Law (LFDA) recognizes only a natural person as an author, and automatically generated content may not be protected in Mexico or elsewhere. Other users may obtain similar results.
• License you grant us: a non-exclusive, royalty-free, worldwide and limited license to store, process, reproduce and display your content to you, solely to provide, maintain, moderate and improve the Service. If you mark a character as public in the catalog, the license also covers showing it to other users while it remains public; you can make it private or delete it at any time, without affecting copies we must keep by law.
• You confirm that you have the necessary rights to anything you upload (for example, avatar images) and that it does not infringe anyone's rights. We may review, moderate or remove content that we reasonably believe violates these Terms or the law.
• Feedback: if you send us comments or ideas, we may use them freely to improve the Service, without payment or attribution.

9. Suspension, termination and appeals

We may suspend or terminate your account, temporarily or permanently, if you breach these Terms, if there is a legal or security risk, or if a competent authority requires it. Except in serious or urgent cases (especially those involving minors, real people or illegal activity), we will tell you the reason. After a ban you may not create new accounts (see section 5).

Appeals: if you believe a moderation, suspension or age-verification decision was a mistake, email sistemas@tuwaifu.com with the subject "Appeal". We will acknowledge receipt within 24 hours and decide within 5 business days. Appeals are reviewed by a different person than the one who made the original decision (or by a person, if the decision was automated).

You can stop using the Service and ask us to delete your account at any time by emailing sistemas@tuwaifu.com.

10. Indemnification

You will be responsible to Tu Waifu for claims, fines, damages and reasonable costs (including attorneys' fees) brought by third parties or authorities that arise from your content, your misuse of the Service or your breach of these Terms or the law. This does not apply to the extent the harm is caused by Tu Waifu.

11. Advertising, links and third-party services

The Service may show ads from third-party ad networks (such as ExoClick) and links to external websites. We do not control or endorse those ads, websites, products or services and are not responsible for their content, their policies or any dealings you have with them; your relationship with those third parties is governed by their own terms.

12. Tu Waifu's intellectual property

The Tu Waifu brand, site design, software and official characters belong to Tu Waifu or its licensors. No rights are granted to them other than personal, non-commercial use of the Service under these Terms.

13. Changes to or discontinuation of the Service

We may improve, change or remove features, or discontinue the Service, for technical, legal or business reasons. If we discontinue the Service, we will give reasonable advance notice when possible so you can request a copy or deletion of your data.

14. Availability and limitation of liability

The Service is provided "as is" and "as available", without warranties that it will be uninterrupted, error-free or that generated content will be accurate. To the maximum extent permitted by applicable law, Tu Waifu will not be liable for indirect, incidental, special or consequential damages, loss of data or profits, or for your use of AI-generated content. Because the Service is free, our total liability to you is limited to the maximum extent permitted by law. Nothing in these Terms excludes liability that cannot be excluded by law or limits rights you have under mandatory consumer protection laws.

15. Electronic consent and communications

You accept these Terms electronically, which has the same validity as a handwritten signature under article 1803 of Mexico's Federal Civil Code and articles 89 and following of the Commercial Code. You agree to receive notices and communications about your account by email or within the Service. The current version of these Terms is always available on this page.

16. Changes to these Terms

We may update these Terms because of legal changes or changes to the Service. We will post the current version on this page with its update date and, for material changes, notify you at least 15 days in advance by email or within the Service. If you do not agree, you can stop using the Service and delete your account before the changes take effect.

17. General terms

• Severability: if any provision is held invalid, the rest remain in effect.
• No waiver: not exercising a right at a given time does not waive it.
• Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and Tu Waifu about the Service.
• Assignment: you may not assign your rights or obligations without our consent. We may assign them, with prior notice, in connection with a sale, merger, reorganization or transfer of the business, provided the acquirer honors these Terms and the Privacy Policy.
• Force majeure: we are not liable for failures caused by events beyond our reasonable control (widespread internet or provider outages, disasters, acts of authority, etc.).
• Relationship: these Terms do not create any employment, partnership, joint venture, agency or representation relationship between you and Tu Waifu.

18. Governing law and jurisdiction

These Terms are governed by the laws of the United Mexican States. Any dispute will be submitted to the competent courts of Mexico, without prejudice to any mandatory consumer protection rights you may have where you live.
