Privacy Policy

This Privacy Policy explains what personal data Tu Waifu (tuwaifu.online and its associated domains) processes, why, who can see it, who we share it with and how you can exercise your rights. It is issued in accordance with Mexico's Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP) and other applicable law.

1. Data controller

The controller of your personal data is Héctor Hugo Rivera González, an individual based in Mexico who operates Tu Waifu. Address for legal notices: available on request at sistemas@tuwaifu.com. For anything related to this policy or your personal data, contact sistemas@tuwaifu.com.

2. Data we collect

• Account data: email address, username and password (stored hashed/encrypted).
• Service content: messages you send, conversations, characters you create or customize, images you upload (for example, for an avatar) and usage preferences, needed for the chat and its memory to work.
• Age verification: if we ask you to verify your age, a third-party provider does it; we only keep the result (verified yes/no) and the date, never a copy of your ID.
• Technical and browsing data: IP address, device and browser type, operating system, pages visited, session or guest identifiers, cookies and local storage (for example, your confirmation that you are 18 or older).
• Communications: information you send us by email (support, reports, appeals, privacy requests).

We do not collect payment details: the Service is free. We do not ask for sensitive personal data; however, your conversations may reveal intimate or sexual preferences. By using the chat you expressly consent to that content being processed for the purposes in this policy. We recommend not sharing identifying information in the chat (full name, address, phone number, documents). The Service is not directed to anyone under 18 and we do not knowingly collect data from minors.

3. Purposes of processing

Primary purposes (necessary for the Service)

• Creating and managing your account and authenticating you.
• Providing the AI chat, saving your history and your characters' memory.
• Automated moderation and, where appropriate, human review; enforcing the Terms of Service, verifying age when needed, preventing fraud and abuse, and handling reports and appeals.
• Answering support and privacy requests.
• Complying with legal obligations and requests from competent authorities.

Secondary purposes (you can opt out)

• Improving the AI and the Service using conversations and content, anonymized or aggregated whenever possible (for example, to improve reply quality, memory or safety filters).
• Usage statistics and metrics to improve the site.
• Showing advertising.
• Sending you Tu Waifu news.

To opt out of any secondary purpose (including the use of your conversations to improve the AI), email sistemas@tuwaifu.com with the subject "Opt out". Opting out will not be a reason to deny you the Service.

4. Moderation and who can read your conversations

Your prompts, characters and generated content are automatically scanned by filters and classification systems to detect prohibited content. Nobody reads your conversations routinely. Only authorized Tu Waifu personnel (currently, the controller) can access a specific conversation, and only when:

• automated systems flag it as a possible violation;
• another user or a third party reports it;
• you ask us to, or it is needed to handle your support request or appeal;
• it is essential to investigate a technical failure or security incident; or
• the law or a competent authority requires it.

The compute providers that run the AI models process your messages automatically to generate replies, as processors acting on our instructions.

5. Cookies, local storage and advertising

We use cookies, browser local storage and similar technologies to keep you signed in, remember your preferences and your age confirmation, and measure site usage (for example, with Google Analytics).

The Service may show ads from third-party ad networks such as ExoClick. These networks may use their own cookies, pixels or identifiers to show ads, cap frequency and measure performance, under their own privacy policies. We are not responsible for the content of the ads or the third-party sites they link to. You can block or delete cookies in your browser settings; some features may stop working properly.

6. Sharing and transfers

We do not sell your personal data. We only share it with:

• Service providers acting on our behalf (processors): hosting, content delivery and security, databases, AI compute, moderation, age verification, email and analytics. They only process data to provide their services to us and under confidentiality obligations.
• Ad networks, for technical and browsing data.
• Competent authorities, when required by law or a valid order, or to report illegal content, especially content involving the exploitation of minors or non-consensual intimate imagery.
• An acquirer or successor of the business, in a sale, merger or transfer of Tu Waifu, who must honor this Privacy Policy. We will notify you beforehand.

Some of these providers may be located outside Mexico, including in the United States. These transfers are those needed to provide the Service or required by law.

7. Your rights

You have the right to access your personal data, correct it if inaccurate, delete it and object to its processing for specific purposes (ARCO rights under Mexican law), and to withdraw your consent. Depending on where you live, you may have additional rights under your local law (for example, data portability or restriction of processing), which we will honor where applicable.

To exercise them, email sistemas@tuwaifu.com with the subject "Privacy request" and include:

1. Your name and the email address associated with your account, so we can reply.
2. Information that lets us verify your identity (or your representative's authority).
3. A clear description of the right you want to exercise and the data concerned.
4. Any other detail that helps us locate your data.

We will reply within 20 business days of receiving your request and, if it is granted, carry it out within the following 15 business days. If you believe your rights were not respected, you can contact the competent data protection authority.

8. Retention and security

We keep your data while your account is active and as long as needed for the purposes above. When you delete your account, we delete or anonymize your data, except what we must keep:

• Evidence of serious violations (especially material involving minors or non-consensual intimate imagery) and minimal data about banned accounts to prevent re-registration: up to 7 years, or as required by an authority or legal proceeding.
• Reports and appeals: as long as needed to handle them and defend our rights.
• Backups: overwritten in periodic cycles; deleted data disappears from them once the cycle completes.

We apply reasonable administrative, technical and physical safeguards, such as encrypting sensitive chat data and secure connections (HTTPS); still, no online system is completely infallible.

9. Changes to this policy

We may update this Privacy Policy because of legal changes or changes to the Service or our practices. The current version is always available at tuwaifu.online/privacy with its update date, and we will notify you of material changes by email or within the Service.
